India Court Issue Notice to Google on Orkut Hate Campaign

Google has been notified by the Bombay bench of the Aurangabad High Court for the alleged spread of hatred about India by its social network service 'Orkut'. Justice A P Deshpande and Justice R M Borde issued the order in response to a Public Interest Litigation (PIL) filed by local Advocate Yugant R Marlapalle.

Google has six weeks to respond. The petition said a community called 'We Hate India', full of anti-India propaganda and with a picture of the Tricolour being burnt — has been created on Orkut. It sought the removal of the community from the site. The petition has also appealed to the government to appoint a 'controller' under the Information Technology Act-2000 to regulate all such communities from operating on the Internet.

Supreme Court lawyer Pavan Duggal said Google would be treated as a network-service provider under Indian law. If the site could be viewed and used in India, the country had a legitimate interest in its contents, he said.

Orkut is an online community that connects people through a network of friends. The web site is aimed at providing an online meeting place to socialise, make new acquaintances and find others with common interests.
